"Early in her teaching career, Marilyn Lubarsky introduced her ninth-grade history students to the Holocaust by showing "Nuit et Brouillard" ("Night and Fog"), a 1955 film containing vivid images of the horrors endured by Jews in concentration camps. "I thought, ‘I’m going to make my students feel my pain,’" Lubarsky, an Upland High School social studies teacher and Mandel Fellowship graduate of the United States Holocaust Memorial Museum (USHMM) in Washington, D.C., told a classroom of Catholic educators at Mount St. Mary’s College Chalon Campus in July. "But I’ll never forget when my most gifted student put her head down on her desk [during the movie]." Lubarsky’s anecdote about a misguided attempt to teach students about the Shoah was met with sympathetic nods and collective sighs from the Southern California-based participants in the Anti-Defamation League’s Bearing Witness Institute, held July 26-30. The four-day workshop focused on the history of anti-Semitism and the Holocaust and addressed the issues of diversity, prejudice and bigotry and how to teach these topics in a Catholic school setting. As global anti-Semitism continues to rise and the number of anti-Semitic incidents in the United States remains constant, Holocaust education for non-Jews is more crucial than ever. "In some ways, it’s more important for non-Jews than Jews to study the Holocaust, just like the issue of racism," said Deborah Lipstadt, the director of the Institute for Jewish Studies at Emory University and a council member of the USHMM. "It’s more important for the perpetrators to study it than for the victims to study it."

"The Turkish government spends millions of dollars to deny the Armenian Genocide. Yet, despite such intense Turkish efforts, and sometimes because of them, the Genocide is becoming more widely known to the world. Scores of countries and international organizations have officially acknowledged it in recent years. The international media frequently refers to the Armenian Genocide. Despite the Israeli government's shameful support for Turkish revisionism, Jewish scholars and commentators have played a major role in reaffirming the facts of the Armenian Genocide. In recent weeks, two more Jewish writers have published very important articles on this issue. Hillel Halkin, an Israel-based author, in an article published in the August 17 issue of The New York Sun, castigated the "Republican congressional leadership and the Department of State "for opposing congressional resolutions "that do nothing more than express official American acknowledgment of the pre-meditated murder, mostly in 1915, of an estimated 1 to 1.5 million Armenians by the armies of the Ottoman Empire" ... Halkin blasts the Israeli foreign ministry for being "chock-full of fearful bureaucrats needlessly anxious about jeopardizing their country's good ties with Turkey." He accuses both the Israeli government and "some Jewish lobbies in America," for having "collaborated shamefully with the Turks on the Armenian issue." Halkin concludes his powerful article by pointing out that since the "Jewish State does not recognize" the Armenian Genocide "for reasons of realpolitik," the Jews should then stop blaming other countries that for their own reasons of realpolitik did not lift a finger while the Nazis were slaughtering the Jews! A second important article, written by Israeli attorney Nir Eisikovits, appeared in the September 1, 2004 issue of "In the National Interest," an online weekly published jointly by The National Interest magazine and The Nixon Center. The writer points out that Israel's denial of the Armenian Genocide is based on two considerations: the belief in the "uniqueness" of the Holocaust, and Israel's self-perceived strategic interests or "realpolitik." Eisikovits considers the first argument "both morally warped and empirically unfounded." By asserting that "Jews do not have a monopoly on pain," he emphatically states: "Jews cannot, simultaneously, attack those who deny the Holocaust and assist others who deny the Armenian Genocide." The writer also points out that the Cambodian and Rwandan genocides have not in any way diminished the Nazi atrocities. As for the considerations of "realpolitik," Eisikovits sadly concludes that Israel's appeasement of Turkey "does not seem to be working." Recalling that Prime Minister Recep Tayyip Erdogan recently accused Israel of "state terrorism," he concludes that Israel has apparently sold its "moral integrity in vain." He also argues: "Realism in international affairs, with all its merits, must be subordinate to a nation's most basic principles rather than dictate them." By refusing to recognize other cases of genocide, "Israel would have undermined the main reason for its own existence," Halkin states. The courageous positions taken by these righteous Jewish writers, combined with all other efforts by Armenians and non-Armenians worldwide would eventually force the governments of the United States and Israel to stop parroting the lies and start telling the truth on the Armenian Genocide."

Holocaust denier refused entry into New Zealand,

"Controversial historian and Holocaust denier David Irving plans to legally challenge the ban on his entry into New Zealand, his Auckland lawyer said Saturday. Irving was prevented from boarding a Qantas flight in Los Angeles Thursday when an urgent fax was sent by the New Zealand Labor Minister in Wellington to the airport, ordering airline officials to bar Irving from boarding an aircraft headed for New Zealand. Irving wished to enter the country for the purpose of speaking at the National Press Club in Wellington, but when he announced his intention in late July, officials in New Zealand warned they would block his entry into the country, the New Zealand Herald reported. Irving, who has promised the "mother of all legal battles", is seeking a judicial review of the ban, the New Zealand news source Stuff reported Saturday. Auckland immigration lawyer Colin Amery, who is acting for Irving, wrote to Prime Minister Helen Clark in an appeal to get Irving into the country, The Dominion Post reported. However, New Zealand has an Immigration Act in place, which forbids entry into the country to anyone who has been barred from another country, and since Irving was expelled from Canada in 1992, allowing him to enter New Zealand would violate the act. Irving has also been denied entry to Germany and Australia. The Immigration Service said that if Irving wished to enter New Zealand he would have to put in a special request, but that these are usually only reserved for humanitarian reasons. Irving, who was already embroiled in a long legal battle against defendant Deborah Lipstadt, author of "Denying the Holocaust," whom he accused of libel, has set up a fund to collect contributions towards his intended legal action. The Holocaust History Project, an organization that compiles information regarding the Holocaust, including direct refutation of Holocaust denial, has labeled Irving one of the most insidious Holocaust deniers alive today, and charges him with lies and distortions of Holocaust history. "Irving has written many popular books, but is not a trained historian and his view of history is very selective," the organization warns. Government officials in Jerusalem expressed satisfaction last month at New Zealand's decision to refuse the Holocaust denier entry into the country, saying that granting Irving passage would have been viewed in Israel and elsewhere as an act of revenge for the recent passport scandal. Israelis Uriel Kelman and Eli Cara were sentenced to six months in jail and fined $100,000 a few months ago for trying to fraudulently obtain a New Zealand passport. New Zealand is convinced the two were Mossad agents, and the incident has cast a heavy cloud over Israel-New Zealand relations."

J'lem cemetery workers may have dumped waste in graves,

"Some 200 graves in the Givat Shaul cemetery in Jerusalem are suspected to have been violated in the past few weeks by employees of the site's sanitation company, who filled them with piles of garbage. The Jerusalem police suspect that contractor Ezra Aslan, who is in charge of the cemetery's sanitation, had hoped to save on waste transport expenses, and instructed to have the waste buried inside graves instead. A sanitation worker who worked for Aslan led police detectives to 30 graves where he had buried garbage. Because of Aslan's expertise the graves were sealed over, so that the act would remain undetected. The police, who decided not to open up the graves they were shown, noted that a few gravestones had not been re-set, and piles of rubbish were peeking out from the ground below. Asland denied having instructed his workers to hide the garbage on the gate at a hearing at the Jerusalem's Magistrate's Court on Sunday to extend his remand. Police launched the investigation when two pistols were discovered in one of the graves. Aslan said he had intended to hand in the guns he found, via his business partner, who works as a security officer in the Shin-Bet, upon his partner's return to Israel from an overseas trip." "France is checking whether it can take legal action against a leading far-right politician who has questioned whether the Nazis used gas chambers in the Holocaust, Justice Minister Dominique Perben said on Thursday. The University of Lyon has urged education officials to suspend Bruno Gollnisch, a professor of Japanese there, for questioning how the gas chambers were used in the wartime slaughter of the Jews and querying the death toll. The president of the European Parliament, Josep Borrell, also called for legal action against Gollnisch, a European deputy who is also the number two man in the National Front party of extreme-right leader Jean-Marie Le Pen. "Mr Gollnisch's comments are absolutely unacceptable," Perben told France Info radio in announcing the probe. "In an affair like this, I think the response should not only be penal ... but it should be political and possibly also professional." France anti-racism laws have made denying the Holocaust a crime, punishable by fines and even prison. Gollnisch, who is known as the intellectual of the controversial party, said on Monday he recognized that the gas chambers had existed but thought historians still had to decide whether they were actually used to kill Jews. He called for an open debate about whether the total number of Jews killed in the Holocaust was actually 6 million as stated. He also questioned the objectivity of leading historian Henry Rousso, who is investigating charges that certain Lyon lecturers were denying the Holocaust, by calling him "a Jewish personality" ... Drive to Nab Last Nazis to Begin in January,

"The Nazi-hunting Simon Wiesenthal Center will begin a campaign in January to flush out the last surviving Nazi war criminals in Germany, the head of the center's Jerusalem office said Sunday. Efraim Zuroff said the campaign will finally begin after several delays on January 27, the anniversary of the liberation of the Auschwitz concentration camp in Poland. The campaign is part of the Jewish group's "Operation Last Chance," a drive which has been underway across eastern Europe to catch World War II criminals who took part in the Holocaust. The center is racing against time as both the perpetrators and survivors of war crimes grow old and die. Zuroff told Reuters last year there was a "window of opportunity" of three to five more years to catch Nazi criminals. The center planned to offer $12,630 for information leading to prosecution of Nazi war criminals, Zuroff said. He said it was difficult to estimate how many suspected war criminals were still at large. But he believed that it could number in the thousands." "It's difficult to estimate but there's no question in my mind that at least several dozen people could be prosecuted," Zuroff said."
French lecturer suspended for doubting Holocaust,

"A far-right leader has been suspended from teaching for one month at a French university for allegedly making remarks that cast doubt on the Holocaust. Guy Lavorel, president of Jean Moulin University in the southern city of Lyon, said in a statement that Bruno Gollnisch's suspension would take effect Friday. The measure is not disciplinary and "respects the presumption of innocence," the statement said. The purpose of the suspension was to avoid "the risk" of any further problems while Gollnisch's case is being considered. A disciplinary hearing was to follow to determine whether further action is merited, the statement said. Gollnisch, who teaches law and Japanese at the university, also known as Lyon III, reportedly cast doubt on the impartiality of a report on Holocaust denial by the historian Henry Rousso. Gollnisch was quoted at a press conference earlier this month as saying "historians might question the number of deaths," and "it is up to historians to decide" on the existence of the gas chambers."

Another Los Angeles-based artist/ activist group created an on-line museum titled Museum of Amnesia (MOA) in protest against MOT's omission of the Armenian genocide. One of the members, speaking to FNews about MOT's handling of political themes within their museum, responded by saying, `In general I think the MOT (LA) appears as this fortress that exhibits filtered-down (Wiesenthal's filter) and in some cases filtered-out information on complex issues. I think the Palestinian writer/ scholar Daoud Kuttab who was quoted in the [New York Times] article really echoes part of MOA's position when he said `What we often see is an attempt to give a superficial meaning to tolerance.'"

"A WA author who wrote a book allegedly based on his harrowing life as a Holocaust survivor is at the centre of a row over his credibility. UWA Press has pulled copies of Stolen Soul from bookshops after a private investigator was called in to probe the author's background. The book, written by Secret Harbour man Bernard Holstein – whose real name is Bernard Brougham – claims to be "the amazing true story of survival and mateship in Auschwitz". The publisher describes the book as "an epic read full of stories of how Bernard underwent experiments, assisted the Underground and even escaped, only to be recaptured and subjected to even greater torture". But this week a UWA Press spokeswoman admitted the publishing house removed the book because of doubts about the author's credibility. Initially, it was convinced of the authenticity of the memoirs of Brougham, who sports a tattoo of the number 111404 on the inside of his left arm, similar to those given to Jews by the Nazis. Brougham, 69, a mining camp cook, says his story is true – but concedes he may never be able to prove it. "It is true, it did happen," he said, acknowledging he had little to support his claims and might never convince his detractors that his death camp experiences were real. He has no immigration papers, no German birth certificate and no living witnesses who could verify his arrival in Sydney from a post-war holding camp in Cyprus. "All I have is what is in my memory," he said. "But I have got nothing to hide. This book is an account of what happened in my life. "I am not a liar, what I have written is true. People might ask how a boy who was only nine at the time can remember what happened in so much detail but I can tell you, once you step through the gates into the barracks at Auschwitz, you instantly grow up. I remember everything. I still have nightmares about it." On the strength of the book Brougham was invited to talk to schoolchildren at the Holocaust Institute in Yokine. His story was questioned when his NSW foster family called UWA Press claiming that not only was he not born in Holstein, Germany, as he said, but he was not Jewish. By this stage the book had sold out its first print run and Brougham was already at work on a sequel, revealing how he fled to Australia after Auschwitz was liberated. A private investigator employed by UWA Press claims that Brougham was born in country NSW, baptised a Roman Catholic in 1942, made his Confirmation in 1952 and even spent time in a seminary training to become a priest. Brougham says he was raised as a Catholic in Australia and his step-parents never discussed his Jewish heritage. He said he would take a DNA test to prove he was not related to his five step-siblings in a bid to authenticate his story and convince UWA Press that it was true. "I remember that three doctors who were members of the Underground (resistance fighters) told me that `one or two or three of you boys are going to get out of this hell hole and you must tell the world what happened here'," he said. In the book he claims that a tearful exchange with a German tourist several years ago convinced him to write his memoirs, which cost him about $70,000 to have ghost-written and published. The book has been selling on the Angus & Robertson website for $26.95 and Brougham has made several book-signing appearances."

"Israeli banks should return money belonging to Holocaust victims or their heirs immediately, Dr. Israel Singer, chief negotiator of the World Jewish Restitution Organization said on Monday. Dr. Singer successfully dealt with the problem with the Swiss banks. "The Israeli banks incidentally got hold of the money, and they should give it back. There is no excuse for holding back the money," Singer said Monday. "People are old and dying. We estimate that they are dying at the rate of two per day. My opinion is that it should be done now; it should have been done last week, it should have been done last year, and 55 years later is too late," Singer said. Singer is on a visit to Israel before publication of a special report on the Israeli banks and Holocaust funds carried out by the Knesset committee for locating Holocaust victims' assets in Israel, headed by Labor MK Colette Avital. The committee has held back its report for more than a year because of the ongoing campaign against it by the five big banks in Israel. The battle is being led by Bank Leumi, which has vehemently rejected demands that the money be returned to victims traced by the committee. According to unconfirmed media reports, the five banks combined hold some 5,000 such accounts with total assets of some NIS 1 billion in real terms.
At least half of the sum was deposited in Bank Leumi. Singer led the struggle against the Swiss banks with a media campaign in 1996-7, publishing historical documents that angered the Swiss government and banks but eventually led them to grant restitution to the victims. Asked what made the Swiss banks pay, Singer says: "Pressure and the justice of our cause." He does not want to use the same tactics with the Israeli banks, for two reasons. The Swiss banks were thieves, he said, but the Israeli banks got hold of the money incidentally ... The second reason, he says, is that Israeli politicians, notably Justice
Minister Yosef Lapid (himself a Holocaust victim) and Avital, have taken upon themselves the task of having the money returned, and sit on the committee. "The Holocaust victims in Israel have the right to vote," he notes. But, he adds, the handling of the subject by the politicians is "not as good as it should be ... after three years, they should have published a report and the money should have been returned." The Israeli banks are well aware of the precedent set by the Swiss banks. In meetings with the committee and the Knesset speaker, Bank Leumi chair Eitan Raff, and the bank's legal representative, Ram Caspi, "warned" that if the report implies the banks benefited from the Holocaust victims' money, this will be used against Israel by the international media. "The Wall Street Journal will say the Israeli banks also hide money, not just the Swiss," Caspi said. Singer retorted: "This is no consideration at all. If you have something that belongs to somebody else, you must return it."

"The struggle that has been taking place for more than a year regarding publication of the investigative report on the bank accounts of Holocaust victims in Israel touches a very difficult and sensitive issue in the history of the State of Israel and the Jewish settlement that preceded it. By means of Zionist companies, many thousands of European Jews who wanted to safeguard their money on the eve of World War II purchased real estate, securities, mortgages and other assets here, thereby making an important and insufficiently appreciated contribution toward strengthening the Jewish settlement and the state-to-be. From the point of view of the young State of Israel, these assets were left without owners after the Holocaust: They weren't recorded separately, no laws for their restoration were legislated, and no real effort was made to locate their legal owners. This led to the emergence of a black market of land traders, and thousands of assets were appropriated or sold to private entities with proper reporting and records. At the same time, the last of the survivors and heirs of the victims ran into an impervious bureaucratic wall when they asked to have their assets returned to them. The affair came to the fore again only in the 1990s, when Israel demanded justice and compensation from banks in other countries that had plundered victims' assets; and in 2000, a parliamentary committee of inquiry, headed by Colette Avital, was established to locate and restore the assets of Holocaust victims. Today, about five years after its establishment, the committee has yet to complete its initial task - publishing the review report on the banks. This not only stems from the matter's complexity and the committee's clumsy work, but also from the banks' action - although they
promised full cooperation, they changed course when the findings showed that there were no less than 5,000 "dormant" bank accounts into which a total sum of around NIS 1 billion in real terms had been deposited. The banks argue that at the time, they transfered all the funds to the Mandate and state authorities, as required by the law. At the same time, they are demanding a change in the method used to calculate the real value of the money - which was in practice in other places around the world - and want the committee to use a different method that would reduce the sums by dozens of percent. Heading the battle is Bank Leumi, which holds, according to the committee's review, the lion's share of the money ... Particularly infuriating is the claim by the heads of the bank that the report's conclusions will be used by the international media as ammunition against Israel."

"The Knesset will grant Bank Leumi an additional hearing on the subject of dormant accounts of Jews killed in the Holocaust that were found at the bank. The Knesset's decision to grant Leumi an additional hearing on the matter is likely to cause further delay to publication of the investigative report on the dormant accounts of Holocaust victims found in Israel.The head of the panel of inquiry into the accounts, MK Colette Avital (Labor), had originally said she would reject the bank's request for an additional hearing, but announced yesterday that she would "consider" granting the request. Avital apparently was swayed by the Knesset's legal adviser, attorney Anna Schneider, who fears the bank will petition the High Court of Justice if its demand isn't granted. Publication of the report of the dormant accounts has been held up for some 18 months on the backdrop of adamant opposition on the part of Leumi and other banks to the panel's conclusions. The auditors, accountants acting on behalf of the panel, found that Israeli banks have some 5,000 accounts belonging to Holocaust victims.The auditors estimate the real value of the accounts at around NIS 1 billion, with some NIS 500 million in accounts at Leumi. The bank strenuously rejects the findings of the inquiry."

"A HOLOCAUST-THEMED autobiography was withdrawn from sale this week following revelations questioning its authenticity. Stolen Soul by Bernard Holstein — who lives in Perth and claimed he was a Holocaust survivor — was removed from bookshelves across Australia earlier this week after the publisher uncovered evidence which challenges the author’s credibility, including claims he spent time in Auschwitz. Publisher Judy Shorrock, who edits the Perth Maccabean, told the AJN she was still “shocked” by the revelations and fears the incident may incite Holocaust denial. “I’ve spent three years working on this book. I am devastated... that it could damage the credibility of the Holocaust — that just makes me feel sick,” she said. The book was pulled from shelves earlier this week by the distributor, University of WA Press, after evidence uncovered by a private investigator — hired at Shorrock’s own expense — refutes Holstein’s claims that he spent time in the Nazi concentration camp."

"The founder of Degel Hatorah, Rabbi Eliezer Menachem Shach, the third anniversary of whose death is marked this week, scrupulously respected the American Diaspora. When he explained his position, according to which territorial concessions should be made to save Jewish lives, he noted that "without the help of the United States, we would not be able to survive even one month on our own, and all those who speak so arrogantly, that we, we, we will be victorious, are despised by the Lord." Against this background it was more than surprising when Shach's successor, Rabbi Yosef Shalom Elyashiv, last week voiced the opinion that "it seems Bush is a friend of Israel and [American Jews] should vote for him." The man who asked the rabbi was David Morgenstern, a Bush activist in Israel. This is not just any foreign intervention in the American presidential elections. In these elections, many Haredi ultra-Orthodox Jews who live in Israel and have American citizenship will be voting for the first time. Some of them are voting in crucial states. The possibility that the votes of these Haredim will tip the scales would certainly have deterred Shach from intervening. A source who is very familiar with Shach's attitude said yesterday that Elyashiv's statement "seems to contradict everything Shach taught." Prof. Menahem Friedman, a researcher of the Haredi population, said Elyashiv's order attests to "a feeling of security and power that stems from the Haredim being citizens of a sovereign state. They feel the Zionist state has redeemed them. They no longer feel they have to be so cautious about not annoying the gentiles." Friedman says Elyashiv's statement is evidence of, among other things, the tough leadership crisis in Haredi Jewry in the U.S., which required guidance from the outside. A source close to Elyashiv responded that "it is not an order, but rather a suggestion." The source said there is no fear the statement will cause anti-Semitism, as Elyashiv voiced support for the Republican candidate, while most American Jews vote for the Democrats. The fact that this is no simple matter is also evident in the response by Knesset member Moshe Gafni (United Torah Judaism). "I have no idea," said Gafni. "I haven't delved into it' ... Israeli law allows people to be tried in Israel for several types of crimes committed beyond its borders - Nazis and their cohorts, for example, terrorists who harmed Israelis or Jews, or Israelis who broke the law abroad. There is now doubt, however, that the passing of the bill initiated by MK Arieh Eldad (National Union) and which is in an advanced stage - being prepared for second and third readings in the Knesset Constitution, Law and Justice Committee - will vastly extend Israeli legal jurisdiction. The bill calls for any Holocaust denier to be tried in Israel. In most countries in the world there is no prohibition on denying the Holocaust. One of Eldad's reasons for submitting the bill was effectively to create a deterrent for the citizens of those countries too. "What I want is that if a Holocaust denier publishes a book in England, he will be considered a criminal in Israel," explained Eldad to a meeting of the committee. He clarified that even if no one is tried, it will be sufficient that deniers know they cannot come to Israel. It is reasonable to assume Eldad's bill would not have reached such an advanced stage were it not for staunch support from Holocaust survivor Justice Minister Tommy Lapid. The ministerial committee on legislation, which Lapid heads, decided to support the bill and thus granted it coalition support. Lapid told Haaretz that he feels denying the Holocaust "is a clearly neo-Nazi crime. Anyone involved in this belongs to the group of criminals whom our arm must reach anywhere in the world. This is essential even if the law remains declarative. We will not hunt them, but they should know that they are on our list of criminals. I am very satisfied and happy that this will be entering our law books' ... Committee chairman Michael Eitan (Likud) said caution must be exercised against zealousness, making the subject itself ridiculous."I feel a bit uncomfortable with this," said Eitan, "because I do not believe this law will be useful forever." This, however, did not prevent him from announcing that he would promote the bill within three weeks, "unless the Foreign Ministry has second thoughts on the matter."

"Federal officials are investigating a $1.3 million stock sale called for by the wife of former Enron Chairman Kenneth Lay just days before the energy company went under, the couple's lawyer says. Attorney Mike Ramsey, in Wednesday's editions of the Houston Chronicle, described the probe of Linda Lay for possible insider trading as "a low and dirty blow." Ramsey said Linda Lay requested that their family foundation sell 500,000 Enron shares to pay charitable obligations. Ramsey said the Lays learned of the investigation "in circumstantial ways," not from the government's Enron Task Force. Andrew Weissmann, who directs the task force, would not comment on the investigation late Tuesday. The New York Times first reported the investigation of the Nov. 28, 2001, sale, which occurred the same morning rumors circulated that a possible bailout of Enron had fallen through and that Enron's credit rating was being cut. "It was sold after the credit-rating agencies acted and before trading was halted," Ramsey said. "It was sold the day of the downgrade, when the information was in the market." Enron stock opened about $4 a share and the family foundation sold at $2.62 a share, Ramsey said. "This was not to enrich anybody; this was to meet charitable obligations," Ramsey said. "In a free-falling market, they did what they could." The foundation, at one time with assets of $52 million, contributed to several causes including Barbara Bush's literacy drive, Houston's Holocaust Museum, M.D. Anderson Cancer Center, Rice University, the Museum of Fine Arts, the Holocaust Museum and First United Methodist Church."

"The wife of a prominent Holocaust denier made an appeal Thursday to a federal judge in Knoxville to help free her husband, who was booted from his Sevier County home last year and wound up in a Canadian prison. "If somebody smashed my window, I have recourse with the law," Ingrid Rimland Zundel said. "If somebody smashes my life (by deporting her husband), I have no recourse. This is a political vendetta. This was a setup. My husband only searches for the truth." U.S. District Court Senior Judge James H. Jarvis found himself in a troubling position. He wanted to help but could not. "This is a tough, tough case for me," Jarvis said. "But I've said it before, tough cases make bad, bad law." Jarvis was disturbed not because he sympathized with the controversial views of Ernst Zundel, 65, but because it appeared that Zundel's case was driven, in part, by politics. "His home country, Germany, wanted him for his preachings, writings on the Holocaust," Jarvis said, noting those views were published on Zundel's well-known Zundelsite Internet page. "This would be a felony under German law." But Jarvis opined that he ultimately had no jurisdiction over Zundel's fate. The U.S. Immigration and Naturalization Service's decision to scuttle Zundel out of the country "was a discretionary one not subject to review by this court." Zundel is a German-born graphic artist and publisher whose involvement with the 1980 pamphlet "Did Six Million Really Die?" rocketed him to infamy as a Holocaust denier and - as some allege - a neo-Nazi. He lived in Canada for decades but had long been denied citizenship. In 2000, Zundel entered the United States under the visitor visa waiver program, which allows people to visit the United States for 90 days at a time without having to go through the process of getting a visa. However, as part of that program, Zundel had to sign a form in which he agreed to waive any rights to contest deportation if INS chose to take such action. While in the United States, Zundel married Rimland and applied for an INS "adjustment" to his status here as a result of that marriage. In the meantime, his visitor visa expired. In February 2003, Zundel was arrested at his home in Wears Valley, where he was preparing to open an art gallery, and deported to Canada. Once there, he was imprisoned and accused by the Canadian government of being a threat to national security. If he loses that court battle, he will be returned to Germany, where he faces a five-year prison term for his Holocaust views. Memphis attorney Rehim Babaoglu handled the paperwork for Zundel's effort to get an INS adjustment. He testified Thursday that he had never before had a client kicked out of the country for overstaying his visa when that client was married to a U.S. citizen and had applied for an adjustment. "I've never seen anything like this in my practice," Babaoglu said. "My opinion is someone took a shortcut, did what they wanted to do, had an agenda. I think the government's got another agenda."

At the end of a week-long Americas tour, Fischer fought back tears as he expressed Germany's shame over the murder of six million European Jews to Sao Paolo's Congregacao Israelita Paulista. "To those of you who forced to flee Germany, I bow before you," Fischer said in the single German sentence of speech delivered in English."In their racist insanity, the Nazis destroyed a blossoming century-old culture. Germany damaged a major part of its own soul." Holocaust restitution - a costly endeavor,

"In the best case scenario, when the International Commission on Holocaust Era Insurance Claims (ICHEIC) finishes its work, it will have spent one dollar on administrative costs for every two dollars it paid to Holocaust survivors and their heirs. According to Pat Bowditch, ICHEIC's chief financial officer, the ICHEIC's total operating budget since its inception in December 1998 is $95.8 million. A large hunk of that total was spent during ICHEIC's first years, when it set up the administrative infrastructure for locating, collecting, processing and paying Holocaust-era insurance policies to survivors and their families. So far, a total of $103m. has been offered to claimants. By the end of 2005, when ICHEIC is slated for dismantling, total offers to claimants could reach as much as $200m., Bowditch told The Jerusalem Post." In the last few months there has been a significant rise in the number of claims." She admitted that by the end of 2005 operating costs would probably exceed the $95.8m. budget, but would grow at a slower pace than the rise in payments to Holocaust survivors and their heirs. Assuming total ICHEIC administrative costs will not exceed $100m. and assuming ICHEIC reaches its $200m. goal, the commission will have spent one dollar for every two dollars it paid out. Stuart Eizenstat, who was Special Representative of the President on Holocaust Era Issues in the last six years of the Clinton administration, says ICHEIC will have spent too much. "I've dealt with arrangements in a wide range of areas including slave labor, insurance, real estate and objects of art, and those figures sound extraordinarily high", Eizenstat told the Post."
